Liability & Service Disclaimer
Technical Middleware Nature: ProFarmAudit exclusively provides a technical software-as-a-service (SaaS) middleware interface designed for the automated structure and passive plausibility matching of spatial agricultural telemetry and livestock records. The data analytics, tracking indices, and generated reports do not constitute formal legal advice, tax advice, or certified agricultural extension services under German law (RDG).
Exclusion of Subsidy Liability: The calculation models and verification profiles function as preventive documentation tools and carry no explicit or implicit guarantee of automatic data acceptance, qualification verification, or payout approvals by national or state agricultural payment offices (e.g., InVeKoS, FIONA). The final review, administrative accuracy, compliance with regulatory filing windows, and ultimate legal liability for submittal accuracy remain the sole, unassignable responsibility of the respective farm manager.
Privacy Policy & GDPR Compliance Statement
1. Controller & Contacts: The data controller responsible for the processing of operational metrics on this web portal under European data sovereignty regulations is the technology partnership of Theodoros Zigkiris & Vergilios Papathomas (GbR i.G.), reachable directly via our central security desk at info@profarmaudit.com.
2. Lawful Basis & Categories of Data Processing: We collect and process personal and operational data strictly based on Art. 6 (1)(b) GDPR (processing is necessary for the performance of a contract or preliminary pilot phase framework) and Art. 6 (1)(a) GDPR via your explicit voluntary form submission consent. The scope of processing is restricted to identifying corporate indicators required for automated validation audits, explicitly encompassing: Operator Name, Corporate Email address, the 15-digit business number (Betriebsnummer - BNR15), integrated IACS/FIONA FLIK field parcel geometry coordinates, and tagesaktuelle national HI-Tier livestock stock registry datasets.
3. Exclusion of Third-Party Infrastructure & Native Data Processing: To guarantee maximum data sovereignty and protect your sensitive agricultural telemetry, this platform completely avoids the integration of third-party form-routing services (such as Formspree) or unsecured external cloud interfaces outside the European Union. All operational metrics submitted through our registration frameworks are processed using end-to-end encrypted protocols (TLS/SSL) and ingested directly into our isolated system architecture with zero third-party data-sharing loops.
4. Primary Hosting Node & Data Flow Infrastructure: The central platform server core, relational PostGIS database tables, and spatial file systems are entirely hosted on a highly secured cloud infrastructure node physically located inside the European Union in Frankfurt am Main, Germany. For the purpose of automated compliance checks, our backend engine dynamically requests data feeds from external public service APIs, specifically remote-sensing spatial bands from the European Space Agency (ESA) Copernicus network and weather telemetry from the Deutscher Wetterdienst (DWD). No personal operational identifiers are transmitted to these external agencies.
5. Strict Data Retention & Erasure Safety Net: Your data is stored securely and processed exclusively for the duration of our closed alpha validation loops. Pursuant to our strict storage limitations and our automated backend retention janitor parameters, all personal and geographic dataset arrays will be permanently and irrevocably deleted from database indices and local disk storage within 30 days following the conclusion of the 2026 pilot tracking period on December 31, 2026, unless an active commercial subscription upgrade or structural legal hold has been deployed.
6. Data Breach Notification Procedures: We employ robust technical and organizational security measures (including end-to-end TLS/SSL connection encryption, isolated Unix socket database mappings, and strict directory read-protection parameters) to safeguard your sensitive agricultural and operational metrics. In the highly unlikely event of a security incident resulting in an unauthorized data breach, compromise, or exposure of personal or operational profiles, we will fully enforce our mandatory obligations under Art. 33 and Art. 34 GDPR. This includes notifying the competent data protection supervisory authority within 72 hours of becoming aware of the breach, as well as providing immediate, transparent electronic notification to all affected farm operators detailing the nature of the incident and any mitigating actions deployed.
7. Your Mandatory Data Subject Rights & Right to Object: Under the GDPR, you possess absolute, non-negotiable rights regarding your stored data profile. You have the right to request access (Art. 15), rectification (Art. 16), complete erasure/right to be forgotten (Art. 17), restriction of processing (Art. 18), and data portability (Art. 20). Furthermore, you have the absolute right to object, on grounds relating to your particular situation, at any time to the processing of your data which is based on Art. 6 (1)(b) GDPR (Art. 21 GDPR). You may withdraw your consent or exercise your right to object at any time by sending a brief, informal notice to our desk at info@profarmaudit.com. You also retain the absolute right to lodge a complaint with a competent data protection supervisory authority (Art. 77).
Terms & Conditions – Pilot Phase Edition
1. License Grant: ProFarmAudit grants the user a simple, non-exclusive, non-transferable, and time-limited right to use the software platform for internal, operational business use of the registered agricultural facility during the pilot phase (grazing period 2026).
2. User Restrictions: The user is explicitly prohibited from copying, modifying, sublicensing, or renting the product or any components thereof. Furthermore, any forms of reverse engineering, decompiling, disassembling, or otherwise attempting to extract or reconstruct the underlying software source code, proprietary algorithms, data parsing structures, or report templates are strictly forbidden. Using the platform to build a competing service is strictly prohibited.
3. Payment & Subscriptions: Participation in the current staging pilot phase is 100% free of charge for the selected pilot cohort operators. No monthly subscription fees, usage-based tariffs, or billing cycles apply during this trial. All services are non-refundable, and no financial claims can be made for user contributions. Future commercial subscription tiers following the pilot phase will require separate contractual agreements.
4. Service Level Agreement (SLA): The provider targets a monthly availability uptime percentage of 99.0%. Scheduled maintenance windows or system downtime caused by lack of data availability from third-party streaming dependencies (e.g., ESA Copernicus satellite array lags, national livestock registry outages) or Force Majeure are excluded from this threshold. No legal remedies or compensation are provided for system downtime.
5. Intellectual Property (IP): The provider retains all exclusive ownership rights, title, and interest in and to the software code, proprietary data aggregation algorithms (such as the Triple-A Audit-Trail), brand logos, custom user interface designs, and trade secrets. The structural layout formats of all generated compliance sheets and PDF audit reports remain the protected intellectual property of the provider. Customers retain full ownership of their raw input telemetry and operational data.
6. User-Generated Content & Data License: By uploading or connecting field boundaries, FLIK polygon coordinates, or herd management data packets, the user grants ProFarmAudit a limited license to process, store, and display that content to fulfill the platform's service purpose. Additionally, the user grants the provider the unrestricted, perpetual right to utilize all submitted operational records in a completely anonymized form to train, optimize, and validate its data analytics algorithms.
7. Termination & Data Deletion: This agreement terminates automatically upon the conclusion of the official pilot phase tracking window on December 31, 2026. To ensure complete year-end statutory compliance trails are preserved for structural audits, a mandatory data safety net period applies. All personal and geographical data stacks will be completely and irrevocably deleted from database indices and local disk storage within 30 days following January 1, 2027, unless an active commercial subscription upgrade or structural legal hold has been deployed.
8. Warranties & Disclaimers: The software application is provided on an "as-is" and "as-available" basis without any warranties of any kind. The provider explicitly disclaims all implied warranties of merchantability, error-free operation, or fitness for a particular purpose or statutory compliance framework.
9. Limitation of Liability: Given the free-of-charge nature of this pilot phase, the provider's financial liability is strictly capped and limited to cases of intentional misconduct or gross negligence. The platform functions purely as a passive middleware data-structuring tool. Any liability for lost profits, indirect damages, or cuts to EU-CAP agricultural subsidies, regional grazing premiums (Weideprämie), or regulatory fines issued by national or state audit offices (e.g., InVeKoS, FIONA) is completely excluded.
10. Governing Law: This agreement and all legal relations arising from this pilot deployment shall be governed exclusively by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for any legal disputes is Frankfurt am Main, Germany.
